TERMS & CONDITIONS
AND CANCELLATION – REFUND POLICY

These Terms & Conditions and Cancellation–Refund Policy (“Terms”) are binding for all passengers and drivers (“User”) who use the KıbRide mobile application (“Application”).
KıbRide is a digital transportation intermediary platform operating in the Turkish Republic of Northern Cyprus.

1. Parties

These Terms are concluded electronically between:
KıbRide (the platform provider), and
Natural persons using the Application as passengers or drivers.

2. Subject

These Terms regulate the conditions of use of the intermediary services provided through the KıbRide Application, as well as the rights and obligations of the parties, cancellation–refund rules, and limitations of liability.

3. Nature of the Service

3.1. KıbRide is not a taxi operator or transportation service provider.

3.2. KıbRide is a digital intermediary platform that brings passengers and drivers together.

3.3. Transportation services are provided directly and solely by the driver.

4. Membership and Account Creation

4.1. Creating a user account is mandatory to use the Application.

4.2. The User accepts that all information provided is accurate, complete, and up to date.

4.3. KıbRide reserves the right to suspend or terminate accounts in case of misleading or false information.

5. Driver-Specific Provisions

5.1. The Driver declares and undertakes that they hold a valid driver’s license and own a vehicle that is roadworthy and legally authorized.

5.2. The Driver accepts that all documents and information uploaded to the Application are accurate and belong to them.

5.3. The Driver is solely responsible for compliance with traffic, tax, and other applicable regulations.

6. Passenger-Specific Provisions

6.1. Passengers agree not to cause damage to the driver, the vehicle, or third parties during the trip.

6.2. Passengers may not engage in unlawful activities or compel drivers to do so.

7. Fees, Subscription, and KıbRide Wallet

7.1. Driver Subscription System

7.1.1. Drivers must pay a subscription fee to provide services through the KıbRide platform.

7.1.2. Subscription fees are collected via IBAN (bank transfer/EFT) or Stripe.

7.1.3. Subscription fees are not commission-based and are non-refundable under any circumstances.

7.2. KıbRide Wallet – Security Deposit

7.2.1. Passengers are required to make a one-time deposit of 150 TL into the KıbRide Wallet in order to use the Application.

7.2.2. This amount does not constitute a trip fare.

7.2.3. The 150 TL deposit is non-refundable under all circumstances.

7.2.4. This amount is not used, retained, or treated as revenue by KıbRide.

7.2.5. The deposit serves solely as a security mechanism used exclusively for payments to drivers in cases of cancellation, waiting time, or similar situations.

8. Cancellation and Use of the Security Deposit

8.1. Passenger-Initiated Cancellations

If a passenger cancels a trip without any fault attributable to the driver, the 150 TL security deposit may be transferred to the driver.

8.2. Five-Minute Waiting Rule

If the driver arrives at the pickup location and waits for at least five (5) minutes, and:
the passenger does not arrive, and
the passenger fails to provide any notification,
the driver may cancel the trip via the Application, in which case the 150 TL security deposit shall be transferred to the driver.

8.3. Cancellations at Different Trip Stages

8.3.1. Cancellation While Driver Is En Route

If the trip is canceled while the driver is en route, the transfer of the security deposit shall be determined based on the distance traveled and time elapsed, and may result in:
full transfer,
partial transfer, or
no transfer
at the discretion of KıbRide.

8.3.2. Cancellation After Driver Arrival

If the passenger cancels the trip after the driver has arrived at the pickup location, the security deposit may be fully transferred to the driver.

8.4. Driver-Initiated Cancellations

If the trip is canceled due to the driver’s fault, the security deposit shall not be transferred to the driver.

9. Nature of the Deposit

9.1. The 150 TL security deposit cannot be refunded in cash or via bank transfer.

9.2. The deposit may only be used within the KıbRide system as a payment instrument for drivers.

10. Discretion and Final Authority

All decisions regarding cancellations, transfers, and evaluations shall be made based on:
the stage of the trip,
elapsed time,
distance traveled, and
the conduct of the parties.
The final and binding authority rests solely with KıbRide.

11. Limitation of Liability

KıbRide shall not be held liable for accidents, delays, damages, or disputes arising during trips.

12. Privacy

Personal data shall be processed in accordance with the Privacy Policy and Driver Privacy Policy.

13. Acceptance and Binding Effect

By clicking the “I Agree” button within the Application, the User is deemed to have accepted all provisions of these Terms.

14. Amendments

KıbRide reserves the right to amend these Terms at any time. Amendments shall become effective upon publication in the Application.

15. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the Turkish Republic of Northern Cyprus.
The courts of the TRNC shall have exclusive jurisdiction over any disputes.

KULLANIM ŞARTLARI, HÜKÜMLERİ
VE İPTAL – İADE POLİTİKASI

İşbu Kullanım Şartları, Hükümleri ve İptal–İade Politikası (“Şartlar”), KıbRide mobil uygulamasını (“Uygulama”) kullanan yolcu ve sürücüler (“Kullanıcı”) için bağlayıcıdır.
KıbRide, Kuzey Kıbrıs Türk Cumhuriyeti’nde faaliyet gösteren bir dijital ulaşım aracılık platformudur.

1. Taraflar

İşbu Şartlar;
KıbRide (platform sağlayıcı),
Uygulamayı yolcu veya sürücü sıfatıyla kullanan gerçek kişiler
arasında elektronik ortamda akdedilmiştir.

2. Konu

İşbu Şartlar, KıbRide Uygulaması üzerinden sunulan aracılık hizmetlerinin kullanım esaslarını, tarafların hak ve yükümlülüklerini, iptal–iade kurallarını ve sorumluluk sınırlarını düzenler.

3. Hizmetin Niteliği

3.1. KıbRide, taşıma hizmeti sunan bir taksi işletmesi değildir.

3.2. KıbRide, yolcu ile sürücüyü dijital ortamda bir araya getiren aracılık platformudur.

3.3. Taşıma hizmeti, doğrudan ve tamamen sürücü tarafından sağlanır.

4. Üyelik ve Hesap Oluşturma

4.1. Uygulama’dan faydalanabilmek için kullanıcı hesabı oluşturulması zorunludur.

4.2. Kullanıcı, verdiği bilgilerin doğru ve güncel olduğunu kabul eder.

4.3. Yanıltıcı bilgi verilmesi halinde KıbRide hesabı askıya alabilir veya sonlandırabilir.

5. Sürücülere İlişkin Özel Hükümler

5.1. Sürücü, geçerli sürücü belgesine sahip olduğunu ve trafiğe çıkmaya uygun bir araca sahip bulunduğunu kabul ve beyan eder.

5.2. Sürücü, yüklediği diğer gerekli tüm belgelerin doğru olduğunu kabul eder.

5.3. Trafik, vergi ve mevzuata uyumdan bizzat sorumludur.

6. Yolculara İlişkin Özel Hükümler

6.1. Yolcu, yolculuk sırasında sürücüye, araca veya üçüncü kişilere zarar vermemeyi kabul eder.

6.2. Yolcu, yasa dışı faaliyetlerde bulunamaz.

7. Ücretlendirme, Abonelik ve KıbRide Cüzdanı

7.1. Sürücü Abonelik Sistemi

7.1.1. Sürücüler, KıbRide platformunda hizmet verebilmek için abonelik ücreti ödemekle yükümlüdür.

7.1.2. Abonelik ücretleri IBAN (havale/EFT) veya Stripe üzerinden tahsil edilir.

7.1.3. Abonelik ücreti komisyon değildir ve iade edilmez.

7.2. KıbRide Cüzdanı – Güvence Bedeli

7.2.1. Yolcular, Uygulama’yı kullanabilmek için bir defaya mahsus olmak üzere KıbRide Cüzdanı’na 150 TL yüklemek zorundadır.

7.2.2. Bu tutar yolculuk bedeli değildir.

7.2.3. 150 TL hiçbir koşulda yolcuya iade edilmez.

7.2.4. Bu tutar KıbRide tarafından gelir olarak kullanılmaz, tahsil edilmez ve harcanmaz.

7.2.5. 150 TL yalnızca iptal, bekleme, mağduriyet ve benzeri durumlarda sürücülere ödeme yapılabilmesi amacıyla kullanılan bir güvence aracıdır.

8. İptal ve Güvence Bedelinin Kullanımı

8.1. Yolcu Kaynaklı İptaller

Yolcunun, sürücünün kusuru olmaksızın yolculuğu iptal etmesi halinde, 150 TL güvence bedeli sürücüye aktarılabilir.

8.2. 5 Dakika Bekleme Kuralı

Sürücünün yolcu alma noktasına ulaştıktan sonra en az 5 (beş) dakika beklemesine rağmen;
Yolcunun gelmemesi
Yolcu tarafından herhangi bir bilgilendirme yapılmaması
halinde, sürücü yolculuğu iptal edip Uygulama üzerinden bildirim yaparsa,
150 TL güvence bedeli sürücüye aktarılır.

8.3. Yolculuğun Aşamalarına Göre İptaller

8.3.1. Sürücü Yoldayken İptal

Yolculuk sürücü yoldayken iptal edilirse;
kat edilen mesafe ve geçen süreye bağlı olarak:
Güvence bedelinin tamamı,
Yarısı,
veya hiçbiri
sürücüye aktarılabilir veya aktarılmayabilir.

8.3.2. Sürücü Varış Yaptıktan Sonra İptal

Sürücü yolcu alma noktasına ulaştıktan sonra yapılan iptallerde,
150 TL güvence bedeli tamamen sürücüye aktarılabilir.

8.4. Sürücü Kaynaklı İptaller

Yolculuğun sürücünün kusuru nedeniyle iptal edilmesi halinde, güvence bedeli sürücüye aktarılmaz.

9. İadenin Niteliği

9.1. 150 TL güvence bedeli nakit iade edilemez, banka yoluyla geri ödenmez.

9.2. Bu tutar yalnızca KıbRide sistemi içerisinde sürücülere ödeme aracı olarak kullanılabilir.

10. Takdir ve Nihai Yetki

İptal, aktarım ve değerlendirme süreçlerinde:
Yolculuk aşaması
Süre
Mesafe
Taraf davranışları
esas alınır ve nihai karar tamamen KıbRide’e aittir.

11. Sorumluluğun Sınırlandırılması

KıbRide, yolculuk sırasında yaşanabilecek kazalardan, gecikmelerden veya zararlardan sorumlu değildir.

12. Gizlilik

Kişisel veriler, Gizlilik Politikası ve Sürücü Gizlilik Politikası kapsamında işlenir.

13. Onay ve Bağlayıcılık

Uygulama içindeki “Onaylıyorum” butonuna basılması, işbu Şartlar’ın tamamının kabul edildiği anlamına gelir.

14. Değişiklikler

KıbRide, işbu Şartlar’ı dilediği zaman değiştirme hakkını saklı tutar.

15. Uygulanacak Hukuk ve Yetki

İşbu Şartlar Kuzey Kıbrıs Türk Cumhuriyeti hukukuna hukuk ve yönetmeliklerine tabiidir.
UyuşmazlıklardaKuzey Kıbrıs Türk Cumhuriyeti Mahkemeleri yetkilidir.
